THINKCARBON TERMS AND CONDITIONS

 

  1. Introduction
    • These Terms and Conditions ("Terms") govern your use of the ThinkCarbon Carbon Estimating Calculator ("Service"), a web-based platform developed and operated by ThinkCarbon Recycling Ltd. ("we", "us", "our", "ThinkCarbon"). The Service is intended to assist in making informed decisions regarding the sustainability of transactions in the recycling industry.

 

  • By accessing our Service either via the thinkcarbon.org website or via the WasteTrade platform at https://www.wastetrade.com/, the user declares that they have read, understood and is bound by these General Terms and Conditions.

 

  1. Access and Usage of the Service
    • We grant you a non-exclusive, non-transferable, revocable licence to access and use our Service for your personal, non-commercial use. The Service is designed to provide estimates of carbon usage and should be used as a guideline to promote sustainable practices within the recycling industry.

 

  • You must not use our Service for any unlawful purpose or in a way that infringes the rights of anyone else. The Service should be used responsibly and in accordance with industry standards and regulations.

 

  • You are responsible for ensuring that all information you provide to us is accurate and up-to-date. The accuracy of the carbon estimates provided by the Service is dependent on the accuracy of the information you provide.

 

  • ThinkCarbon reserves the right to immediately block access to the Carbon Estimating Calculator if it is used for activities which violate the law or the rights of third parties. A non-exhaustive list of excluded activities within the use of ThinkCarbon includes:
  1. Use or access of ThinkCarbon in a matter determining its use by other users or functionality
  2. Use of automated or mechanical procedures to detriment the ThinkCarbon technology/platform
  3. To mis-advertise ThinkCarbon as being anything other than an estimation platform which does not belong to any user
  4. To publish any illegal, indecent or defamatory material on ThinkCarbon or publically defame ThinkCarbon in any manner which is untrue

 

  1. Intellectual Property Rights
    • All intellectual property rights in our Service, including but not limited to text, graphics, user interfaces, visual interfaces, photographs, trademarks, logos, sounds, music, artwork, computer code, and the design, structure, selection, coordination, expression, "look and feel," and arrangement of such content, are owned by or licensed to us.

 

  • Except as expressly provided in these Terms, no part of our Service may be copied, reproduced, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted or distributed in any way without our prior written consent.

    • Any user utilising the ThinkCarbon estimation calculator via the WasteTrade platform is referred to and also bound by the WasteTrade terms and conditions in addition to these terms and conditions. The WasteTrade terms and conditions can be found at on the WasteTrade platform.

 

  • Users using the ThinkCarbon estimation calculator via the WasteTrade website are also referred to the WasteTrade data protection and privacy policy which can be found on the WasteTrade Platform.

 

  1. Limitation of Liability
    • Our Service is provided "as is" and we make no representations or warranties, express or implied, about its accuracy, completeness, or suitability for any particular purpose. The Service is intended to be a tool to assist in the promotion of sustainable practices within the recycling industry and should not be relied upon as the sole determinant of the sustainability of a particular transaction.

 

  • Our Service relies on other third-party map providers and the accuracy of the calculations made is dependent upon the accuracy of the third-party map providers. ThinkCarbon reserve the right to change the map provider that they decide to use and whilst they will endeavour to use the most accurate provider possible, this is not guaranteed.

 

  • To the maximum extent permitted by law, we will not be liable for any loss or damage (whether direct, indirect, consequential or otherwise) arising out of or in connection with your use of our Service.

 

  • The user indemnifies ThinkCarbon against all claims, legal disputes, liabilities, claims for damages, costs and expenses arising from the use of ThinkCarbon by the user or by other persons using his access data.

 

  1. Changes to these Terms
    • We reserve the right to change these Terms at any time. Any changes will be posted on this page and will take effect immediately upon posting.
